Insurance Claim Rights

Being involved in an accident and dealing with your insurance company can be confusing and frustrating. The State of Texas has laws to inform the consumer of their insurance claim rights. You can visit the Texas Department of Insurance at www.tdi.state.tx.us to become familiar with these laws. On occasion our customers will ask questions regarding the insurance claim process. Below is a list of the most common questions asked. Please review your insurance policy. All policies are not the same.

 

  1. My insurance company told me to get three estimates. Is the correct?  No. There is not a law requiring you to get more than one estimate. Only one estimate is required to determine the amount of damage.
  2. Do I have to have my car repaired at a shop my insurance refers me to? No. You can have your car repaired at a shop of your choice.
  3. Do I have to take my car to the insurance drive-in claims center? No. It is not mandatory . You have the option of going to the claims center or leaving your car at a shop of your choice. The insurance company will inspect the car at the shop you select.
  4. If I take my car to the insurance drive-in claims center, am I required to use the insurance companies preferred shop. No.
  5. If I do not use a shop referred by my insurance company  will I be responsible for paying for my rental car? No. If your policy states that you have rental coverage you do not have to pay for your own rental car. Most insurance companies bill rental car agencies directly and some may ask you to pay up front and then reimburse you. Check your policy.  If the other involved party is at fault, their insurance company pays for your rental car and you can not be required to pay upfront for the rental.
  6.  My insurance company states that if I do not use one of their referred shops the claims process takes longer. Is this true? No. Most insurance companies are required to look at your car within 2-3 days.
